In Pakistan, property inheritance is governed by Islamic law for Muslims and applicable succession acts for non-Muslims. Proper transfer requires legal documentation, correct registration, and accurate identification of heirs.

  • Spouse, parents, children, and siblings (hierarchy and shares depend on Faraid rules for Muslims)
  • Legal heirs must be identified through a Union Council or court-issued Heirship Certificate
  • Inheritance shares differ based on children, surviving spouse, and other family members

Required Documents

  • Death Certificate of deceased
  • CNIC copies of all heirs
  • Property documents (ownership deeds, land records)
  • Fard Malkiat from local Patwari
  • Heirship Certificate or Succession Certificate
  • Affidavits or No Objection Certificates from other heirs

Property Transfer Process

  1. Obtain death certificate from Union Council
  2. Get Heirship Certificate listing all legal heirs
  3. File Succession Certificate (for movable assets if required)
  4. Apply for mutation (Intiqal) in local Patwari/Tehsildar office
  5. Update bank, utility, and NADRA records with heirs’ CNICs
